Dublin Van Hire - Rental Agreement Terms & Conditions
1. YOUR CONTRACT WITH US
Dublin Van Hire (the Owner) agrees to rent the Vehicle described overleaf to you (the Hirer). By signing this rental agreement, the Hirer accepts these conditions. Please read this agreement carefully. If there is anything you do not understand, please ask a staff member to explain.
2. HIRE PERIOD
The Hire Period is as defined in Clause 1. The Hirer will have the Vehicle for the period stated overleaf, and Dublin Van Hire may agree to extend this period upon request. The Vehicle will remain on hire until the off-hire procedure is completed. The Vehicle will be deemed off-hire for insurance purposes when delivered to Dublin Van Hire or an authorized representative.
3. WARRANTIES BY HIRER & DRIVER TO THE OWNER
The Hirer warrants and undertakes to Dublin Van Hire:
A. To return the Vehicle in the same condition received, ordinary wear and tear accepted.
B. That all information supplied is accurate.
C. That the Driver and any additional Driver meet all legal and insurance requirements.
D. Not to sell, assign, let, rent, or dispose of the Vehicle or its accessories.
E. Not to use the Vehicle in violation of any law or regulation.
F. Not to remove the Vehicle from the Republic of Ireland without prior written consent.
G. To observe and perform all insurance terms and conditions.
H. To authorize Dublin Van Hire to verify personal driving and credit information.
I. To fully indemnify Dublin Van Hire against any loss, damage, or injury caused by negligence or breach of this Agreement.
4. ACCEPTANCE OF THE VEHICLE
A. The Hirer or Driver and a Dublin Van Hire staff member will inspect the Vehicle's condition before hire.
B. Acceptance of the Vehicle confirms that the Hirer has examined it and found it in good order.
5. YOUR RESPONSIBILITIES
A. The Hirer is fully responsible for the Vehicle from collection until return.
B. The Hirer must return the Vehicle at the agreed time and location.
C. The Hirer must ensure proper care of the Vehicle, including maintenance checks and security.
D. The Hirer must not allow unauthorized work on the Vehicle.
E. The Hirer must immediately report any loss, damage, or breakdown.
F. The Hirer must not continue to use the Vehicle if it may cause further damage.
G. The Hirer must report theft or malicious damage to Dublin Van Hire and the police immediately.
H. The Hirer must not use the Vehicle for unsuitable purposes or in severely adverse weather conditions.
6. WARRANTIES BY OWNER TO THE HIRER
Dublin Van Hire warrants and undertakes to the Hirer:
A. The Vehicle is roadworthy and suitable for use at the start of the hire period.
B. To identify and inform you of any existing damage before you sign this agreement.
C. To ensure suitable insurance cover when the Hirer avails of our motor insurance and damage protection policy.
D. To arrange prompt repairs in case of breakdown.
7. CONDITIONS FOR USING THE VEHICLE
A. Only authorized drivers may use the Vehicle.
B. The Vehicle must not be operated in violation of this contract.
8. PAYMENT
The Hirer agrees to pay Dublin Van Hire all rental fees, charges, and additional items as they fall due, including deposits, mileage charges, fines, tolls, and damage costs.
9. RENTER'S OWN INSURANCE
If the Hirer elects to use their own insurance, they must keep the Vehicle insured on a comprehensive basis and comply with all policy terms.
10. OWNER'S INSURANCE
Dublin Van Hire offers insurance options, including Legal Liability, Collision Damage Waiver (CDW), and Theft Protection Insurance (TPI). The Hirer's financial liability and excess charges are detailed in this section.
11. IN THE CASE OF AN ACCIDENT
The Hirer must notify Dublin Van Hire and, where applicable, their insurers within 24 hours of an accident, complete an accident report, and not admit liability to any person.
12. DATA PROTECTION
Dublin Van Hire collects personal data as necessary for the rental. The Hirer has rights to access, update, and correct this data under the Irish Data Protection Act.
13. HIRER'S INDEMNITY PROVISION
The Hirer agrees to defend, indemnify, and hold Dublin Van Hire harmless from all losses, liabilities, damages, injuries, claims, demands, costs, and expenses incurred in any manner from this hire transaction.
14. TERMINATION
Dublin Van Hire may terminate this Agreement for breach of contract or other specified circumstances.
15. GOVERNING LAW
This agreement is governed by and construed in accordance with the laws of the Republic of Ireland.
